Wrongful Foreclosure

Definition

A claim that a foreclosure sale was conducted improperly — for example, without proper notice or an actual default — causing the owner to lose the property or its value.

Hypothetical

A bank forecloses while the owner is current on a court-approved payment plan. Because there was no real default, the owner may have a wrongful-foreclosure claim.
