Negligence
Definition
The failure to use ordinary care, causing harm to another. Proving it requires a duty, a breach of that duty, causation, and damages.
Hypothetical
A driver runs a red light and hits a pedestrian in the crosswalk. He owed a duty to drive carefully, breached it, and caused real injuries — the elements of negligence.
