Burden of Proof
Definition
The obligation to prove a disputed fact. In civil cases it is usually a preponderance of the evidence; in criminal cases the State must prove guilt beyond a reasonable doubt.
Hypothetical
A prosecutor's evidence leaves the jury genuinely unsure whether the defendant was the driver. Because the State bears the burden beyond a reasonable doubt, that doubt requires an acquittal.
