Not every appellate issue gets a fresh look. The standard of review often decides the appeal before the briefing starts.

Appellate courts review some questions fresh and defer heavily on others. A pure legal question gets a clean look; a discretionary call stands unless the judge clearly abused discretion.

Knowing the standard tells you which arguments are worth making and which are nearly hopeless. It shapes the whole appeal.
